Arab man facing murder charge

An Arab man has been charged with felony murder in connection with a shooting death in Baileyton Tuesday.

Robert L. Kimbrough, 27, was arrested late Thursday by the Cullman County Sheriff’s Office. He was also charged with first-degree burglary.

Kimbrough, after being named a person of interest, surrendered at the Sheriff’s Office in the company of his attorney, Tommy Drake of Cullman.

The Sheriff’s Office responded to a call early Tuesday morning of someone entering an occupied home in Baileyton. Johnathan Andrew Smith, 34, of Blountsville, was shot inside the home allegedly by Mike Sweatmon, the resident of the house, according to the Sheriff’s investigators.

Smith was later found in a car with gunshot wounds and was pronounced dead at the scene. Sheriff Matt Gentry asked Wednesday for public assistance in locating Kimbrough as a person of interest in the case.

Gentry said investigators had identified Kimbrough as the driver of the car. He also said Kimbrough is believed to have entered the house with Smith and was also armed at the time. The intent of men’s entry into the home has not been released by investigators.

“We are still conducting interviews,” Gentry said. “There is potential to identify other suspects.”

Kimbrough was charged with murder because he allegedly participated in a crime in which a death occurred, Gentry said. “In this case, the person who was killed broke into the house. The other person can be charged for participation.”

Sweatmon has not been charged and at this time. Investigators have said it appears his actions were self defense. The District Attorney’s office will review the case and determine if any charges are merited.

Gentry said Sweatmon has cooperated fully with investigators.
