Patrick Bates has led the incorporation effort and is obligated to pay for the cost of the election, estimated at $5,000-$10,000.

Bates and other supporters of the effort have drawn an anticipated municipal boundary that he said includes about a third of the registered voters in the community. A resident of Berlin for more than three decades, Bates said the condition and maintenance of roads was a motivating force in pushing for incorporation.

Bates filed the petition for Berlin’s incorporation in August with the Cullman County Probate Judge’s Office. Probate Judge Tammy Brown and her staff have reviewed the territory that is proposed as the municipality.

Brown published a series of required public notices of the election in The Cullman Times, which gave any interested parties 30 days from the date of the last publication to file a written objection to election application. Brown reported no objections were filed and a Notice of Compliance was granted for the election to proceed.
