Kimberly man convicted of murder

A Kimberly man has been convicted of capital murder in the 2009 slaying of a Pelham police officer.
According to reports, Bart Wayne Johnson was found guilty on of two counts of capital murder; one of the counts was for killing an on-duty police officer and the other was for causing death by shooting from an occupied vehicle.
Johnson was arrested in December of 2009 on charges of capital murder after shooting Pelham police officer Phillip Davis during a traffic stop on Interstate 65. He lived in Kimberly with his wife and two children.
According to reports, Shelby County District Attorney Robby Owens said the prosecution is asking the jury to support the death penalty; Johnson and his defense council are seeking life in prison without parole. Reports say Johnson’s defense also pleaded insanity for him.
Testimony for both the penalty phase and sentencing phase ended this week, and now a jury must recommend to the judge which sentence should be carried out. Shelby County Circuit Judge Al Crowson will render the final verdict at a later date.
Johnson was formerly a pharmacist at Fred’s Pharmacy in Jasper.
