The Gardendale City Council on Monday denied a request from Walgreen’s for two licenses: One for retail beer, off-premises and one for retail table wine, off-premises.

Gardendale Mayor Othell Phillips said the request did not meet the criteria of city ordinance 97-10, which states that a location where alcohol would be sold must be at least 500 feet from a church, school or library, measured from nearest door to nearest door.

Walgreen’s door is 428 feet from the nearest door of the city’s former civic center, which is now owned by Gardendale First Baptist Church, according to Gardendale Mayor Othell Phillips.

“That was the only reason it failed the ordinance,” he said. “Our hands were tied.”

The ordinance allows for some exemptions to the 500-foot rule, including grocery stores and restaurants that sell at least two meals a day.

In other business, the council:

• adopted an ordinance allowing the Governmental Utility Services Corporation of Morris to extend a private sewer into Gardendale

• hired Lisa Waldrop as a public safety dispatcher level two in the Gardendale Police Department

• promoted Jeff Kennedy to construction equipment operator in the Gardendale Public Works Department

• voted to clean up properties and assess the charges to the following residences for violation of the city’s weed control ordinance: 5708 Garden Wood Dr., 501 King Rd., 2531 Snow Rogers Rd., 4951 and 4969 Brentwood Dr., 576 and 588 Holly Drive

• awarded a plaque of appreciation to Brandon McCrae, a city employee who just returned from a year-long deployment in support of Operation Iraqi Freedom

The next Gardendale City Council meeting is scheduled for Aug. 16, 6 p.m., at Gardendale City Hall. Meetings are open to the public.
